The recent U.S. Court of Appeals decision in CAHNR v. Chapman/Smith that challenged the Epple (IDT) process for incapacitated, unrepresented nursing home residents will be reviewed. Attendees will learn what decisions an IDT can and cannot make under the revised Epple IDT process and how to utilize the new process to ensure appropriate, diligent decisions are made.

Assembly Bill 5 (AB 5) severely restricts the use of independent contractors in the state and has serious implications for long term care providers that use a variety of employment arrangements. The bill that becomes law on Jan. 1, 2020 upheld the California Supreme Court Dynamex decision targeting the misclassification of workers.
